SC 8/258/12888
Date

Description
Petitioners
Abbot of Fecamp.
Addressees
King and council.
Occupation
Abbot of Fecamp
Nature of request
The Abbot of Fecamp, states that John de Barton, merchant, has claimed that a trespass was committed against him in Normandy, and that he has not had justice from the Abbot - falsely, as can be seen from the King of France's letters on this subject - and has obtained a writ to the Sheriff of Sussex to arrest the Abbot's goods: so that £280 have been levied from the Abbot's goods without due process and contrary to law. The Abbot asks that the process might be brought into parliament so that it might be examined, and law and justice done to him.
Nature of endorsement
The record and process on this are to be brought into Chancery before the council, together with a certain petition from the parliament held at Westminster, and also all other things touching it.It seems to the council that arrest according to the law of the land ought not to be awarded against someone who is a terre tenant in this land, nor should execution be made of his goods and chattels in this land; because of which the order of arrest against the Abbot is to be repealed, and the Sheriff is further to be ordered to cease completely from making execution of the said arrest. And all the Abbot's goods and chattels arrested by virtue of the said command which are in the hands of the Sheriff or of anyone else of his bailiwick are to be restored to the Abbot or to his attorney. And if the Abbot's growing corn has been assigned to the said John, this assignment is to be repealed, and that Abbot is to use them for his profit.

Note
CCR 1327-30 p.286 is dated 18 May 1328, and would seem to be in response to this petition, which is almost certainly the one presented to the Northampton parliament mentioned by SC 8/112/5565. CCR 1327-30 pp.429-30 is dated 18 February 1329.
