Description
Petitioners
William de Whitewell.
Name(s)
de Whitewell, William
Addressees
King and council.
Nature of request
William de Whitewell states that he presented a clerk to the church of Skeyton, but that John de Skeketon brought a prohibition against him to the Bishop of Norwich, that no parson should be received before it was established whether the presentation belonged to William or John. And he did this through malice, to hinder William until time had passed so that the Bishop could give it, because in a plea between William and Robert de Skeketone, John's father, it had been adjudged that they would present on alternate occasions. William had the record and process of this plea brought before Gilbert de Thornton, and had a writ of judgment to have John summoned to court, but John did not appear, fearing the amount of damages that would be awarded against him. Gilbert adjudged that William should present on this occasion, and gave him a writ to the Bishop to receive his presentee, but, because John had not appeared in court, he refused to award damages without the King and council. William asks that a jury might be summoned before Gilbert de Thornton, to inquire into whether John disturbed him by this prohibition as he claims, or not, and that his damages might be adjudged to him.
Nature of endorsement
[Deleted] At the request of Thomas de Wanberge.Coram consilio.Because the other made opposition to prosecute his right. He has not been convicted of malicious prohibition. So he is to have nothing in respect of the damages.
