Date
[c. 1344]
Description
Petitioners
Margaret de Cerne, widow of John de Cerne.
Name(s)
de Cerne, Margaret
Addressees
King and council.
Nature of request
Margaret, widow of John de Cerne, states that because her late husband's manor of Draycot Cerne in Wiltshire was held of the King in chief, his lands and tenements in Dorset, in which he and she were jointly enfeoffed, as can be seen from a fine levied in the King's court, were seized into the King's hand by the Escheator after John's death. It has been found by inquisition that she was jointly enfeoffed in these lands together with her husband, and that none of their lands in Dorset is held of the King in chief, but, although she has sued in Chancery to have a writ to the Escheator to remove the King's hand, they have refused to give her one. She requests a writ to the Escheator to remove the King's hand, and that she might have delivery of the lands and tenements, together with the issues in the meantime.
Nature of endorsement
The inquisition returned in Chancery is to be examined, and she is to show her charter if she has one, and the part of the fine. If it is found that she is jointly enfeoffed as this petition claims, and the tenements of which she is thus jointly enfeoffed are not held of the King and the office has been fully served, then a writ is to be sent to the Escheator to remove his hand, together with the issues, as has been the custom before now, always saving the right of the King.
