Merk requests that it be granted that he be released at mainprise as he has been taken by the sheriff of Lincoln by a capias issued on the judgment made against him on a trespass maliciously prosecuted against him by Colby. He requests this so that he can pursue a suit by a writ of attaint against the jurors of the inquisition, and asks that the levying of the damages cease until the attaint is tried.
