Nature of request
John, son and heir of Hugh Coterell, states that the King brought a writ of right against John Rodyert and Alice his wife concerning two thirds of half of the manor of Darley in the High Peak, and that when John defaulted Alice was received to defend her right, and vouched Hugh Coterell to warranty. The parties were given a day at the octave of Michaelmas in the King's twenty-fourth year, but before that day both Alice and Hugh died. Although the King's writ was extinguished in law by death of the parties, his attorney has proceeded with the case, erroneously as John claims. He has pleaded this, but nevertheless the justices have awarded execution to the King, and told him to sue by petition. He requests a remedy, so that he might not be disinherited by this wrongful judgment.
