Nature of request
John de Askham states that the vicarage of Brixham is of the patronage of the alien Prior of Totnes, whose temporalities are in the King's hand because of the war, and that the King recovered the right of presentation to this church in Common Pleas, and presented Hugh de Askham, who was duly instituted. But one John Wrey, chaplain, by virtue of a bull of the court of Rome, entered this vicarage and held it by force and arms. He was outlawed for this, but has received a charter of pardon, which is still in the hanaper because he cannot find sufficient mainprise in Chancery that he will not sue on this matter in court Christian or disturb the possession of Hugh de Askham. Notwithstanding this, by colour of this charter he has demanded by force that Hugh leave his benefice and pay him for his damages, in contempt of the King and contrary to the judgment brought in Common Pleas. John asks that the charter of pardon might be examined, and that if John Wrey has acted contrary to it, that it might be repealed, or not delivered to him without good and sufficient security.
Nature of endorsement
A commission is to be issued to certain people to arrest the provisor and all those who with force and arms or by process of bulls have made a disturbance or acted otherwise to the defeasance or ruin of the judgment brought on this in the King's court, or who have obstructed the King's presentee in the possession he acquired by virtue of the said judgment. And the charter is to remain in the hanaper until he has found good and sufficient security with a heavy penalty that neither he nor others in his name will challenge or obstruct the King's presentee in his possession.
