- Roger du Plat states that he brought an assize of novel disseisin against Richard de Holond, Hugh de Chedle, and others, and that the assize found that Roger was disseised by Hugh de Chedle, who enfeoffed Richard de Holond with the tenements, and that because Richard was an adherent of Thomas, Earl of Lancaster, the lands were taken into the King's hand. Roger brought a writ of the King to the justices to render judgment, but they did nothing. He brought another writ, but they refused to render judgment because the lands were in the King's hand because of Richard's adherence to the Earl of Lancaster. He asks that he might not be barred or disinherited by this adherence, and that he might have a writ to the justices to render judgment, and another writ to the keeper of the King's lands in Lancashire to give the tenements back to him.
- Nature of endorsement
- Coram rege.Because the King cannot fully know by this return who was the tenant on the day when the writ was purchased, and who was the tenant on the day when the assize was taken, the justices are to be ordered to inform him, and also to send the tenor of the record.[Deleted] It seems to the council that the justices who took the assize ought to be ordered to proceed to judgment, notwithstanding the fact that the tenements are in the King's hand, if it pleases the King; and therefore coram rege.[Another endorsement has been completely deleted.]. . . is to come . . . certification made by the justices in Chancery, as the petition claims.
