Nature of request
John Fraunceys states that, following a writ from Syward to his predecessors as sheriffs of London regarding a debt of £140 owed by Preston, Preston was duly taken and imprisoned. He and Vyvent, now dead, then took responsibility on their appointment, but following a writ of exigend from the common bench brought by Furnivale against Preston, they delivered Preston to that court, and he was committed to the Fleet prison. However, a clerk mistakenly recorded that Preston was committed to the sheriffs, to be returned to the common bench at a given day, when in fact he was never returned to them. Syward has now sued a writ against him, accusing him of allowing Preston to go free in return for the £140 debt by means of the false enrolment. Fraunceys therefore requests that the chancellor summon before him the Warden of the Fleet and the Clerk of the Common Bench, in order to examine the matter and correct the error in the roll.
Nature of endorsement
The king, by assent of parliament, wills that the chancellor call before him the warden of the Fleet and the clerks of the Common Bench, and examine them in the presence of the justices of the common bench as to the truth of this, and make whatever corrections seem right. And also send a writ of supersedeas to the same justices to stay the plea.
