SC 8/213/10645

Description
Petitioners
Robert de Werkesworth (Wirksworth); Margaret de Wirksworth, wife of Robert de Wirksworth.
Name(s)
de Werkesworth (Wirksworth); de Wirksworth, Robert; Margaret
Addressees
King and council.
Nature of request
Robert and Margaret Werkesworth state that on the Tuesday before the feast of the Ascension last Percival and William Pensax, Ryvell, Sherman and many others expelled them with force and arms from their house at Ulleskelf, stole and destroyed all their goods and chattels, laid waste to the trees in the garden, and expelled them from their other lands and tenements there. This has been found by inquisition returned in Chancery and sent to the King's Bench, but they do not dare to approach their house or to sue at common law, and Percival refuses to respond to any writ they can purchase. They request that the Pensax, Pensax, Ryvell and Sherman be made to answer before the King and council so that they can have their house back.
Nature of endorsement
Because Percival and William Pensax were indicted before the sheriff of Yorkshire and because Percival is a common malefactor in the country, considering that the petitioners cannot have recovery at common law, it is agreed that a writ should be sent to the sheriff of Yorkshire to arrest those named within and bring them before the King's council to answer to the petitioners for the wrongs specified in this petition and to do what the council orders, on pain of £100. Also a writ should be sent to Percival and the others, on their allegiance, to come to make their response, and to receive in the aforesaid form.
Places mentioned
Ulleskelf, [West Riding of] Yorkshire.
People mentioned
Percival Pensax
William [Pensax], son of Percival Pensax
