Gunsales, merchant of the ship called 'Seint Marie de Grace', states that when the ship with its merchandises was captured on its way to Southampton, he asked Polymond for aid and recovery since he was a foreign merchant who was not of the King's enmity. Polymond sent the King's serjeant of Southampton to move the ship and merchandises to safety there, telling Foxton and his companions to allow this on pain of forfeiture, but Foxton said that they had no ship or merchandises and that the serjeant's life was in danger if he didn't leave, and Foxton and the others took the ship with its merchandises and sailed it to the high sea.
