Request for remedy in the delays in the holding of an assize of novel dissesin relating to lands in the Welsh marches brought against John Charlton and others, resulting from John's appointment as justiciar of Ireland.
Nature of endorsement
Let a writ be ordered to the justices to take the assize in the said county, rehearsing the process and containing the effect of this petition, that, according to the ordinance recently made at Nottingham, to continue such assizes, was made at the request of the great because they ought not to lose their lands and tenements while they were outside the land in the service of the king and it is not reasonable that the assize which is postponed in regard to the lady because John, son of John Charlton, who had nothing in the tenements, is in the king's service, and that having viewed the record and process, if they find that the lady was put in assize as tenant of the tenements and that the assize was postponed in regard to John son of John by default and that if they can find by the assize or other manner that John son of John had nothing in the tenements on the day the writ was purchased and that he approached the king since the assize was postponed towards, him, that they go forward and take the assize, notwithstanding the other command ordered to them to the contrary.
