Nature of request
The Prior of Tywardreath makes three requests:1) He states that he and his predecessors have been seized of the hermitage of Baldwin's Bridge in the wood of Restormel in pure and perpetual alms, until Edmund, Earl of Cornwall, had the woods enclosed, depriving them of a great part of their commons of woods and pasture; and that because he realised that he had done this, he assigned them 4 marks annually from the hands of the Sheriff of Cornwall, to support a chaplain in the hermitage. The Prior received this in the time of Robert de Stokheye and Thomas de la Hyde, Sheriffs of Cornwall, in the time of the Earl and the time of the late King, but he has since ceased to receive it. He asks that he might either have the enclosed lands, or the 4 marks.2) He states that he should have the tithe from three mills in Lostwithiel, as they are in Lanlivery parish, of which he is parson, but that he has lately received the tithe only in coin and not in corn. He requests justice, so that his church is not diminished.3) He states that he has a mill in demesne in Restormel, the mill of Lamford, in the same parish, from which he does not receive any tithe, either in corn or in money. He requests the tithe due to his church.
Nature of endorsement
To the first petition: A writ of Chancery is to be sent to the Treasurer and Barons of the Exchequer, containing the allegation of the complainant, and they are to instigate an inquiry by certain faithful people into the truth about the withholding of the 4 marks and the reason for it, and when, and by whom, and how, and in what way. And the inquisition is to be returned in the Exchequer and the King is to be informed of it if he wishes.To the second and third petitions: he is to clarify if the mills are the King's mills. Then the King will take counsel and will cause what is just to be done. And if they are another's then the King has no cause to interfere, but he is to seek a remedy in court Christian.
