SC 8/202/10085
Date
[c. 1302]
Description
Petitioners
Ralph Darundel (Arundel), son of Oliver Darundel.
Name(s)
Darundel (Arundel), Ralph
Addressees
King and council.
Nature of request
Ralph, son of Oliver Darundel, states that Margery his mother gave him of her inheritance the manor of Caerhays, together with Trengoffe and Trevorder, for himself and his heirs, and that he was in peaceful seisin of them; but that Margery afterwards enfeoffed Roger Dynkpen and Emmeline his wife with them; and they [expelled him forcibly] and leased the lands to the Earl of Cornwall for term of life. Ralph brought a writ of novel disseisin before the justices appointed to hold assizes in Cornwall, but the Earl died before the assizes could take place; so he brought another writ of novel disseisin against Roger and Emmeline, and then, because the tenements were in the King's hand, another writ against the Sheriff. But the Sheriff has attested that he had a writ of the King to plough and sow in these tenements, and to improve them for the King's use; this writ came by Roger's procurement and is likely to bar Ralph from his right without the King's aid. He requests justice, and that the council should take advice on whether he should have the cause of the taking of these lands into the King's hand [brought] into Chancery.Copies of a writ to the Sheriff of Cornwall ordering him to plough and sow these lands, and to maintain their buildings, and of another writ to the Sheriff of Cornwall requesting information on this matter follow, together with a memorandum from the Sheriff, which is identical with SC 8/202/10084.
Nature of endorsement
He is to sue to the Chancellor to have the inquisition examined.

Note
The writ for CIM 1219-1307 no.1894 is dated 6 August 30 Edward I (1302) and CCR 1296-1302 p.560 is dated 19 October 1302: whether these date from before or after this petition is hard to tell, but as the petition includes transcripts of two writs dated 4 February and 21 May 29 Edward I (1301), they would seem to be roughly contemporary. Thomas de la Hide seems to have been Sheriff of Cornwall for most of the period between 1300 and 1307: Roger de Inkpenne was appointed in 1302 but did not account. Roger was also Sheriff between 1286 and 1288: which is probably the time when he disseised the petitioner.
