Nature of request
The petitioners state that they were in dispute in Chancery with Ambrose Barker the elder about certain lands in Chignall in Essex, part of the manor of Chignall, and that last April a writ was sent to Ambrose to allow them to enjoy these tenements peacefully until the dispute was resolved; but that on the last day of July, and on the second, third and fourth days of the present month of August, Ambrose Barker the younger and others, at the command of Ambrose Barker the elder, forcibly entered various parts of these lands and carried off the crops of William Hawkynes, contrary to the writ, and trusting in the Queen's free pardon shortly to be granted to them. Ambrose Barker the elder has also refused to repair the fences round his pastures in Chignall, but nevetheless has impounded the pigs and other livestock of William Marden that have wandered onto these pastures, forcing him to pay heavily to replevy them, and, now, knowing that William Marden cannot at present replevy his livestock because all commissions and patents of Sheriffs are currently void, has on 29 July impounded a horse belonging to him. And because these offices are now suspended, the petitioners have no remedy at common law. They ask the Queen to grant a writ or letter of injunction to Ambrose Barker to return the horse and not to trouble William Marden further until the matter is resolved, to restore the goods taken from William Hawkynes, and to appear and answer to the aforesaid.
