Nature of request
Plesyngton and Venour request that they or Plesyngton as the person to whom the reversion of the lands pledged by Venour now pertain be received to pay the sum due with the costs in which Venour was obliged to Deopham, and that they can have a writ for their delivery, or a suitable remedy be ordained. Deopham has received delivery of the lands of Venour for failure to pay a sum due under a statute merchant, he suing a writ before the sheriff who had taken his robes, and receiving them at an extent lower than their true value. As he was entitled to do, Venour sold the land to Plesyngton and they both appeared before Thorp to pay the money and the costs and requested a writ to summon Deopham at a certain day to receive the money and costs and to deliver the lands, the justices did not wish to do this or provide any other remedy.
Nature of endorsement
Let a writ be ordered under the great seal to the justices before whom the process was . . . to grant a writ of warning by a scire facias towards the party to be before them at a certain day to receive the money which is owed together with the costs, and deliver the land to those who ought to have it by right notwithstanding the order made to the justices contrary to this.
