SC 8/175/8739
Date
[1334]
Description
Petitioners
Ralph de (Coldyngham (Coldingham).
Name(s)
de (Coldyngham (Coldingham), Ralph
Addressees
King.
Nature of request
Coldyngham requests that it be ordered that the burgage that he holds in Berwick be held as his uncle, whose heir he is, held it quit of the £4 rent, and that he can have a writ to the sheriff on this. His uncle bought the burgage from Frysel quit of all but 6d. rent to be paid to the king, and held it until he was ousted by Robert de Bruce when Frysel re-entered and leased the burgage to Fleming who in turn leased it to Myndrom. Coldyngham recovered the burgage but the bailiff and sheriff are now distraining him for the rent of £4, and he sued at the parliament at York for an inquisition into this which found for him.
Nature of endorsement
Let the inquisitions returned into Chancery be viewed, and if it is found that it is as the petition supposes, then let right be done in Chancery.
Places mentioned
Berwick-upon-Tweed, [Northumberland]
York.
People mentioned
Thomas de Coldyngham (Coldingham), uncle of the petitioner
Simon Frysel (Frisel)
Robert de Bruys (Bruce, Brus)
Patrick Flemyng (Fleming)
Giles de Myndrom (Mindrom).
Note
The petition is clearly after the recapture of Berwick in 1334, and the petition can be firmly dated to 1334 by an order to the sheriff on the 8 July 1334 to allow the petitioner to enjoy the burgage quit of the rent (Rot. Scot., vol. I, p.275).
