Nature of request
Wigeton [requests remedy] as he was arented waste land in the New Forest by Foxley and others assigned to make such arents by the late king which he enclosed at his own cost, but he has been unable to have any profit from it because the people of Fawley claim common there and have thrown down his hedges and banks and threaten him and his people, and now the sheriff has been commanded to levy the rent and arrears.
Nature of endorsement
Let it be ordered to the treasurer and barons by writ containing the effect of the petition that they hear the complaint of the petitioner and call before them those who claim the common and other that are called, and hear their arguments, and if they are able to find by inquisition that the petitioner was disturbed by the commoners and the king is not able to approve the said waste then the petitioner should be discharged of the arrears and the rent; and if they find that the commoners have no right to common, or that the king is able to approve of the waste and the commoners have sufficient pasture and they disturbed the petitioner of taking his profit then they should do right for the damage, and the petitioner to answer the king of the arrears and rent.

The petition is dated to 1338 as the petition was transcribed by Matthew Hale who ascribed a date of 1338 to the group of petitions amongst which this belongs (Rot. Parl., vol. II, p.101a (no.13)).
