Reference
SC 8/170/8453
Date
[c. 1361]
Description
Petitioners
Simon de Benyngton (Benington); Idonia Benyngton (Benington), wife of Simon de Benyngton; Roger de Shipbrok (Shipbrook); Margaret de Shipbrok (Shipbrook), wife of Roger Shipbrook
Name(s)
de Benyngton (Benington); Benyngton (Benington); de Shipbrok (Shipbrook); de Shipbrok (Shipbrook), Simon; Idonia; Roger; Margaret
Addressees
King and council.
Nature of request
The petitioners request that the king [? view] the testament of John Sterre under the seal of the bishop of London and give remedy so that Sterre's heirs are not disinherited. John Sterre devised land and tenements to his sons in his testament, but although it was proved by the ordinaries of the Church, because it cannot be found enrolled in the Guildhall it cannot be executed.
Nature of endorsement
They should sue in the Guildhall to prove the testament according to the custom of the city and so that the business can have a writ of execution.
Places mentioned
London
Guildhall, London.
People mentioned
John Sterre
Robert [Sterre], son of John Sterre
Nicholas [Sterre], son of John Sterre
Thomas [Sterre], son of John Sterre
Nicholas [Sterre], son of John Sterre.
Note
The petition is dated to c. 1361 on the basis of references to the division of lands belonging to Idonia Benington and Margaret Shipbrook's brother between them and their husbands, though this does not seem to directly relate to this petition (CCR 1360-4, p.288). In addition, the Beningtons and their son and heir were apparently dead by 27 June 1363, so that the petition clearly predates this (CCR 1360-4, p.481).
