Reference
SC 8/169/8427
Date
[c. 1372]
Description
Petitioners
Richard Dautre.
Name(s)
Dautre, Richard
Addressees
Council.
Nature of request
Dautre requests that a remedy be ordained for him as he was seised of several manors in Yorkshire but was disseised by Caterton and Thomas Dautre. He brought an assize against them in 48 Edward III, but they gave the tenements to Lord Neville to maintain the plea against Dautre. Because of this maintenance he did not dare to pursue his right, and no one would come from the country to York to give their verdict. This is against the statute of champerty.
Nature of endorsement
He should sue by writ concerning the statute, and concerning the free tenement he should sue at the common law.
Places mentioned
Elslack, [North Riding of Yorkshire]
Rimington, [West Riding of Yorkshire]
Bugthorpe, [East Riding of Yorkshire]
York.
People mentioned
John de Catherton (Catterton)
Thomas Dautre
Lord Neville
Ranlyn de Stoke.
Note
The petition is likely to date to c. 1372 as the king ordered the commitment of land in Elslack and Bugthorpe to Richard Dautre and land in Rimington to Thomas Dautre on 8 May 1372 (CFR 1369-77, pp.167-8). It is not clear whether this was action on the part of the king to resolve the dispute, but as no mention is made of the role of Neville here, the commitment may be a little distant from the petition.
