Nature of request
John and Alice de Senclier state that they arraigned an assize concerning the diversion of water in Merriott which is harming their free tenement in Chiselborough, against John de Merriott and others, by which diversion they have lost profits from Chiselborough mill of 10 marks yearly. And because the manor of Merriott is held of the King in chief and in the keeping of Talbot because Merriott is underage, the justices of the assizes in Somerset delayed taking the assize. The justices were then ordered by the King's writ under the great seal that if they learned that the diversion was made by Merriott and others since the death of George de Merriott, they should proceed with the assize according to the law of the land. And then, at Talbot's procurement, the King ordered the justices, by his writ under the targe (privy seal), not to take the said assize until the King had been advised, whereby the petitioners cannot have a settlement in the matter. They had another writ to proceed with the assize, by virtue of which it was found by inquest that the diversion had been made since George's death by those named in the writ. And then the King by his writ ordered the justices to surcease from taking this assize, contrary to the form of the Statute previously made and the law of the land. Wherefore the petitioners request that they can have a writ to the justices that if it has been or should be found that the diversion was made by John de Merriott or any other named in the writ since George's death, that they should proceed with the assize according to the law of the land, notwithstanding any order made or to be made to them, so that the petitioners are not disinherited and their justice delayed without reason.

The writ should go to the justices and if the process is as the petition claims they should proceed to take the assize and do justice according to the first commands that came to them under the great seal, notwithstanding the said letters under the targe (privy seal).

Dated on the guard to 1334-5, with reference to Rot. Parl. Vol. II, p. 86 and CFR 1327-37, p. 435, a 1335 commitment of the keeping of the lands late of John St Clare in the king's hand by reason of the minority of his heir; thus the petition must predate his death. However it is noted on the guard that it may be earlier, with reference to CPR 1327-30, p. 492, a 1330 licence for John de St Clare to enfeoff Chiselborough; and C 143/208/12.
