Fitz Hugh requests that, whereas he brought an assize of novel disseisin of his free tenement in Mickleton against Clifford, Eglesfield and others, which was to be continued until a perambulation had been made between Yorkshire and Westmorland, and Eglesfield then brought a writ of trespass against the petitioner asserting that he has taken Eglesfield's cattle into the land in dispute, that the plea be superseded until the said perambulation is made.
Nature of endorsement
Because the council ordained that all pleas pending by original writs concerning the land in dispute should be continued until the perambulation has been made, it should be sent by writ of the great seal to the justices before whom this writ of trespass is pending so that they can learn by inquest or in other manner if the cattle were taken to the said land. And the plea should be continued until the perambulation has been made.
