Description

Addressees
King and council.
Nature of request
The King's father granted the executors of Christina de Marish the manors of Langley and Wraysbury with the goods and chattels found within valued at £221 16s 5d (which Marish held for the term of her life) for 3 years after her death for the execution of her will. They returned the manors into the king's hand, for which the king granted them the manor of Overstone for 7 and a half years in recompense. The executors then demised Overstone to Appleby for the same term for £50 annually, who then ejected them from Overstone and seized its goods and chattels, because of which the manor was seized into the King's hand, so that the executors cannot execute the said testament. The executors request that the king grant that they may have the manor of Overstone and its goods and chattels according to the aforesaid commission.
Nature of endorsement
Because the business was begun before the treasurer and barons of the Exchequer, let it be ordered by the King's writ that the whole aforesaid business be examined diligently before them, and that furthermore they proceed in the same business, and if ...

Note
Dated on the guard to c. 1317, with reference to CPR 1313-18, p. 564. A date of c. 1315 seems more probable since the entry in the Patent Rolls (a synopsis of which follows) appears to be a response to this petition. It is a 1316 document by Edward II stating that when, on 29 September 1312, half a year after the death of Christiana de Mareys, her executors surrendered to the king the manors of Langley and Wraysbury (which they held for a term of 3 years for the execution of her will), wishing to make recompense for the remaining two and a half years, he granted them the manor of Oveston for a further 7 and a half years. Afterwards, when the executors demised Oveston to Robert de Appleby, clerk, for the same term, for £50 annually paid to them, he ejected them from the manor and seized the goods and chattels in it until, on account of his trespasses, the manor was taken into the hands of the king in November 1315. The king, upon the petition of the executors, and in consideration that there are 4½ years of the original term to run, grants them £300 to be received at the Exchequer, by half-yearly installments of £50. CCR 1327-30, p. 43 adds that the date on which Appleby ejected the executors was 20 June 1315.
