Complaints are referred to the Commission for Local Administration in England by the authority concerned in the complaint, or by a member of that authority. An investigation is not normally undertaken until the authority concerned has had a chance to use its own procedures to resolve the complaint locally.
The commission consists of three local commissioners, each of whom investigates complaints arising in a particular area of the country. In addition, the Parliamentary Commissioner for Administration is an ex-officio member of the commission. The commissioners are appointed by the Queen on the recommendation of the Secretary of State for the Environment. They hold office"during good behaviour" and until the age of 65.
Complaints relating to maladministration prior to 1 April 1974 cannot be investigated.
