The petitioners state that one Robert Flewelyn of Monmouth, yeoman, was arrested in London of suspicion of felony, and committed to Newgate gaol, but that because Thomas Chaucier, esquire, alleged before the justices of gaol delivery that he was a clerk, convicted of felony in Oxford, and rescued by students of the university when he was being transferred to the prison of the Ordinary of the diocese of Lincoln. He was therefore sent back to Newgate prison, until a writ of Chancery was sent to bring him before Chancery, where Thomas Chaucier again made his allegation; and he was transferred to the keeping of the Ordinary, and the petitioners discharged of him. However, the justices of gaol delivery of Newgate are accusing them of letting him escape, if they do not have a writ directing them to discharge them of him: which they cannot have, as the previous writ of corpus cum causa is lost and was not put on record in Chancery. They ask the commons to ask the King and lords to grant power to the Chancellor to issue a writ discharging them.
