SC 8/149/7443
Date
[? c. 1332]
Description
Petitioners
Thomas Beauchamp, Earl of Warwick; Robert de Clyfford (Clifford).
Name(s)
Beauchamp, Earl of Warwick; de Clyfford (Clifford), Thomas; Robert
Addressees
King and council.
Nature of request
The Earl of Warwick and Robert de Clyfford state that the Bishop of Durham is claiming by petition in parliament to have forfeitures of war between the rivers Tyne and Tees, citing an example from the time of Henry III, and is requesting the manors of Barnard Castle and Gainford, which the Earl of Warwick holds and which were forfeited by John de Baillolf, and the manor of Hart, which Robert de Clyfford holds and which was forfeited by Robert de Bruys; and that the King has granted him forfeitures of war provided that he does not expel without response anyone who entered any lands by feoffment of his progenitors. The petitioners state that their manors are in the wapentake of Sadberge, which is not part of the Bishop's franchise - as indeed is the manor in the case cited by the Bishop, making it a false precedent - and that the Bishop is demanding the manor of Hart from Robert de Clyfford in his own court, by a writ of right by reason of the forfeiture of war that he claims. They ask that the parties might be summoned before the Bench to show their evidence there, and that justice might be done to them there.
Nature of endorsement
With regard to the first point: the King does not want them to be expelled without a response, as was previously ordained in parliament. And concerning the fact that Robert is impleaded in the Bishop's court: he is to aid himself by his charter. With regard to the second point: they are to have a writ to attach the Bishop to appear before the King on a certain day to show why he has accroached to himself, by virtue of his charter, lands and tenements which are not of his lordship or within his franchise; and the writ of attachment is to contain the effect of this petition.
