Description
Petitioners
Benedict le Walche (Galche), son of Denise la Walche (Galche).
Name(s)
Walche (Galche), Benedict
Addressees
King and council.
Nature of request
Benedict, son of Denise la Walche, states that Anneys de Maddinggle gave Robert le Walche and Margaret his wife two messuages in the town of Cambridge, to them and to the heirs of their bodies, and if they died without heirs of their bodies, then to Robert's heirs. Robert died without an heir of his body, and Margaret then took a second husband and destroyed the charter for the grant; then she died. Benedict, Robert's kinsman and heir then brought a writ of formedon in the remainder against Magaret's second husband, but because the charter had been destroyed he could have no recovery. He requests a remedy, for himself and for others in a similar case.
Nature of endorsement
The action is invalid because the wife is dead.

One of a collection of petitions published on pages 387ff of Rot. Parl., vol I., which all seem to date from around 1322. This dating is confirmed by PROME, Appendix of Unedited Petitions, 1307-1337, Rotuli Parliamentorum I, pp. 387-415, which dates these petitions to 15 or 16 Edward II (8 July 1321-7 July 1323).
