Nature of request
Thomas Hersant, John Hersant, Ralph du Celer, Richard Laxman, William Payn, Peter del Hostelerie, John le Coteler and John Bacheler, of Whitby, state that they were maliciously indicted of the death of Nicholas Fox by an inquest held before the Coroner of Whitby, and that by virtue of this indictment, they have been imprisoned in Whitby for two years and more, because the justices do not want to come there to deliver them, and the people of Whitby do not want to send the indictment out of their franchise. They ask that Adam de Hoperton, William de Ruston, and Thomas de Burton, or two of them, might be appointed to hear and determine (oyer and terminer) this indictment, so that they may be released from prison according to the law and custom of the realm.

A writ of oyer et terminer is to be issued to them, in accordance with the form of the petition, to the justices named there.
