Nature of request
John de Wauton states that he had a tenement in Woldingham in Surrey, of the gift of John de Wautone, his father, but that Gilbert de Clare, Earl of Gloucester and Hertford, Joan his wife, and others disseised him of it. He brought a writ of novel disseisin, but it was delayed, and the Earl died before any judgment could be brought. He brought another writ, but, because the Countess claimed to have all her tenements of the King's gift, the justices demanded a special warrant from the King to hold the assize. He sued to the King for this, but the Countess' tenements were then taken into the King's hand because of her marriage. John sued to the London parliament, and was told to acquire a writ against the Earl and Countess and the others; he did so, but the justices will not take the assize without a special warrant from the King, because the tenement is in his hand. He asks the King to order the justices to proceed.

Note
The London parliament mentioned here would seem to be that of the autumn of 1297: this is the date that best fits with the death of Gilbert de Clare in December 1295, and his widow's remarriage to Ralph de Monthermer in 1297, with the King's seizure of her lands.The writ noted in CIM 1219-1307, no.1507 is dated 23 May 18 Edward I (1290), but does not appear to be directly connected to this petition. The petitioner seems to have died in 1304; a writ to the escheator was issued on 20 May 1304 (CFR 1271-1307, p.493), and a presentation to the church of Woldingham, in the King's hand, was made on 15 January 1305 (CPR 1301-7 p.309).
