Description
Petitioners
John de Warthil of York.
Name(s)
de Warthil, John
Addressees
King and council.
Nature of request
John de Warthil of York states that he brought a writ against Hugh de Selby concerning a messuage and some land in Youlthorpe, but Hugh delayed his suit for nine years by acquiring seven protections, although he did not go to war during this time. John brought a writ before Roger Brabason and his companions to attach him to answer to the King for this deceit, but Hugh has left the county and gone to court to try to obtain a letter from the Marshal or some other great lord attesting that he was in the war. John asks that he might not be allowed to do this, as he is prepared to aver when the King wishes that he did not go.
Nature of endorsement
He is to sue his writ before Roger Brabazon and his colleagues.
Places mentioned
York
Youlthorpe, [East Riding of] Yorkshire.
People mentioned
Hugh de Selby of York
Roger Brabason (Brabazon).
Note
From the hand and the mention of Roger Brabazon (justice of King's Bench 1290, Chief Justice of King's Bench 1295-1316) this petition seems likely to date from the latter part of the reign of Edward I.
