Nature of request
Robert de Werkesworth and Margaret his wife state that on the Tuesday before the feast of the Ascension last, Percival Pensax, William, his son, Robert Ryvell and Robert Sherman, with a great number of others, expelled them with force and arms from their house at Ulleskelf, stole and destroyed their goods and chattels, laid waste to the trees in the garden, and expelled them from their other lands and tenements there. These things have been found by inquisition returned in Chancery and sent to King's Bench, but they do not dare to approach their house or to sue at common law, and Percival refuses to respond to any writ they can purchase. They ask the King and council to order Percival and the others to answer to Robert and Margaret before them, so that they can have their house back.
Nature of endorsement
Because Percival Pensax and William his son mentioned here were indicted before the Sheriff of Yorkshire for the articles mentioned here as appears from the said indictment returned in Chancery and sent to King's Bench, and also because it is attested that the said Percival is a common malefactor and maintainer in the country, considering that the supplicants cannot, through poverty, have recovery at common law, it is agreed and assented that a writ should be sent to the Sheriff of Yorkshire to take and arrest the said Percival and William and the other malefactors named here, wherever they are found within his bailiwick, whether within franchise or without, and to have them before the King's council to answer to the supplicants for the wrongs and damages specified in this petition, and further to do and receive what is decided by the council in this matter, on pain of £100. And a writ is also to be sent to the said Percival and to the others, on their allegiance, to come to make their response, and to receive in the aforesaid form.
