Nature of request
The petitioners state that John Vyvyan presented a petition against them to the present parliament, and was granted writs of proclamation to the Sheriff of Cornwall, to proclaim that the petitioners should appear before King's Bench at the octave of Hilary last, to answer to John Vyvyan or anyone else for the murder, woundings and other offences mentioned in the act produced in response to the petition, and that they were then to be committed to ward, to remain there without bail or mainprise until the matter was determined; and that if they did not appear, they were to be considered as convicted. Because this act did not stipulate that John Vyvyan and any others should sue with effect, the petitioners were afraid that if they presented themselves they would be imprisoned, and that those who sued against them would delay their suits to keep them in prison indefinitely; and also Elizabeth was and is pregnant, and could not appear without danger to her life. For these reasons they did not appear, and are now convicted and attainted in blood. They ask the commons to ask the King to ordain, with the assent of the lords and commons and by authority of parliament, that the act and the convictions might be null and void, and that they might remain in the same condition as before, and their heirs be able to inherit as before.
