Date
[c. 1321]
Description
Petitioners
Prior and Convent of St Martin's, Dover.
Addressees
King and Council.
Nature of request
The Prior and convent of St Martins, Dover, state that Henry II gave their church to Archbishop Theobald for the use of Benedictine monks, and the Archbishop declared that, when the priory was vacant, a monk of Holy Trinity Canterbury should become Prior. However, the Prior of Holy Trinity then seized various rights from the monks of Dover, contrary to the form of their foundation, and consequently Edward I recovered the advowson from the Prior of Holy Trinity. The Prior of Holy Trinity, following the death of Archbishop Winchelsey, challenged this judgment, excommunicating the monks when he failed, and following the death of the Prior of Dover he again claimed the presentation, preventing them from making an appointment and causing a variety of oppressions. The present King has ordered that this should cease. However, they have received no new monks since the time of Archbishop Robert, and they therefore request remedy against the Prior of Holy Trinity, that their house be restored to the Archbishop of Canterbury, and that he allow monks to join their house again up to the original number.
Nature of endorsement
[Long, detailed description of the processes of the case, recording that judgment went against the Prior of Canterbury, and stating that the Archbishop be ordered to allow the Prior of St Martin's to admit new monks to his house.]
Places mentioned
Dover, [Kent]
Canterbury, [Kent]
London.
People mentioned
Henry [II], King of England
Theobald [of Bec], Archbishop of Canterbury
Prior of Holy Trinity, Canterbury
Edward [I], King of England
Robert [Winchelsey], Archbishop of Canterbury.
Note
On 3 June 1319 Edward II granted custody of St Martins to the sub-prior, reciting the terms of the judgment under Edward I and the resumption of the advowson from Holy Trinity, Canterbury, and following complaints from the monks (c.f. SC 8/128/6387 and SC 8/145/7210). The present petition clearly relates to this same on-going matter, but given that it is explicitly from a Prior, it presumably dates from shortly after the appointment of the new Prior, John of Sholden, in 1321.
