SC 8/128/6382
Date
[? 1376]
Description
Petitioners
William de Mouncastell, William de Stapilton and John de Denton.
Name(s)
de Mouncastell; de Stapilton; de Denton, William; William; John
Addressees
Council.
Nature of request
The petitioners request that writs be sent to the Exchequer discharging them of fines placed upon them for their non-appearance as jurors. They state that they had been empanelled to appear before the justices of assize in the case of novel disseisin between Orreton and the Skeltons, but had not appeared on the due day because they were taking part in a march day at the request of the Warden of the March. They had spoken to the justices on their return, and their fines were lifted, but they are nevertheless being pursued for payment.
Nature of endorsement
The Bishop of Carlisle and Lord Clifford, wardens of the March, record in parliament that the petitioners were present at the march day on that day, and Fulthorpe also recorded that the sums should be discharged, and thus the Lords state that a writ of discharge should be sent to the Treasurer and Barons of the Exchequer.
Places mentioned
Carlisle, [Cumberland]
Scotland.
People mentioned
Elizabeth [de Orreton], wife of Giles de Orreton
Giles de Orreton
Clement de Skelton
Joan [de Skelton], wife of Clement de Skelton
William de Fyncheden, justice of assize
Roger de Fulthorpe, justice of assize
[Thomas Appleby], Bishop of Carlisle, Warden of the March
[Roger de Clifford], Lord Clifford, Warden of the March.
Note
The petition refers to events which occurred in 45 Edward III (1371-2), and the dispute involving the assize of novel disseisin was still underway in 1374. However, the address to the council would suggest it may have been presented to the 1376 parliament, as suggested in a note on the guard, referring to C 49/43/10, a summary of petitions probably presented to that parliament.
