Reference
SC 8/125/6226
Date
[c. 1388]
Description
Petitioners
John de Mountagu (Montagu), knight.
Name(s)
de Mountagu (Montagu), John
Addressees
King and Lords in Parliament.
Nature of request
John de Mountagu asks that the records and processes of a case brought be William de Montagu in the court of chivalry be examined before the King, in order that the judgment made against him be revised. He states that William brought the case concerning the unlawful detention of certain documents, and the lieutenants of the constable and marshal convicted him. He appealed to the King, but, on bad information, the King upheld the judgment, and fined him costs of 2500 marks.
Nature of endorsement
[None]
People mentioned
William Mountagu (Montagu), Earl of Salisbury
Mathew de Gornay, lieutenant to the Constable of England
John Multon, lieutenant to the Marshal of England.
Note
This petition evidently relates to the long-running dispute between the Montagu brothers in the Court of Chivalry which continued for many years from 1382 onwards. Orders to the Duke of Gloucester confirming his right to act in this case were made on 26 November 1387 and 15 January 1388. The January order states that the King has upheld the decision of the court, and this is probably the allegedly mis-informed decision by the King noted in the present petition. If so, the petition probably dates to soon after the January order, and hence possibly to the Parliament which opened in February 1388.
