Reference
SC 8/124/6198
Date
[1322-1326]
Description
Petitioners
Stephen de la More; Philip de Ayllesbure (Aylesbury).
Name(s)
More; de Ayllesbure (Aylesbury), Stephen; Philip
Addressees
King and Council.
Nature of request
The petitioners state that they stood as surety to the former king with Berkeley and Badlesmere for £372 10s 11d for the executors of the Countess of Cornwall. The lands of Berkeley and Badlesmere are now in the king's hands, and the goods of the countess have been delivered to her executors, Chapele and Clare, and therefore the petitioners request a writ to make the executors acquit them of this debt, and another writ suspending the debt until the executors appear in court to acquit them.
Nature of endorsement
They should sue in the Exchequer if it seems good to them.Stephen de la More.
People mentioned
Thomas de Berkeley the father
Bartholomew de Badlesmere
Margaret [de Clare], Countess of Cornwall
[Edward I], King of England
John de la Chapele, executor of the Countess of Cornwall
Richard de Clare, executor of the Countess of Cornwall.
Note
The petition alludes to the forfeiture of Badlesmere following the events of 1322, and the death of Thomas de Berkeley in July 1321. As such, the Countess in question must be Margaret de Clare (widow of Edmund of Almaine, Earl of Cornwall), who died in 1312. For the Berkeley estates to be in the king's hands, the petition presumably dates from between the imprisonment of Maurice and Thomas de Berkeley (son and grandson of the Thomas mentioned in the petition) in 1322, and the release of Thomas in October 1326. Given that More's arrest was ordered in September 1322 for his involvement in the events of that year, this may possibly associate the petition with the May parliament of 1322. The original agreement between the petitioners and Margaret's executors therefore presumably took place under Edward I, at least five years before Margaret's death.
