The Home Office has involvement in the passage of legislation and in the issue of individual Commissions Rogatoires. These are letters issued by foreign courts or magistrates requesting evidence from a person or persons living in the UK. The Home Secretary is responsible for passing the Commissions Rogatoires to the relevant British courts or police authorities, and for issuing orders under section 5 of the Extradition Act 1873 to allow persons to give evidence on oath. If persons refuse to give evidence, the Home Office returns the Commission Rogatoire to the enquirer.
