Description

Report of Giles Rooke on 1 individual petition (Ann Russell, prisoner' mother) on behalf of George Russell, tried (with Alexander Hewett and Joseph Robinson, both found not guilty) at the Lancashire Assizes, for croft breaking and the theft of fustians (cloth, velveteen and Genoa cord), value, over £20, property of Thomas Sharrocks, dyer and bleacher, on 5 June 1798. Evidences supplied by Thomas Sharrocks, Margaret Robinson, James Roberts, Phillip Warmington, William ------, constable and the prisoner. Sharrocks had lost goods from his croft to the value of above £500 in the previous 12 months. There is a letter from the Duke of Portland granting 7 days remission of execution in order to obtain the judge's report 'which, if unfavourable, the Law must take it's Course'. The judge considers croft breaking a crime now reaching to a 'very alarming Height'. Grounds for clemency: first offence, petitioner (Ann Russell) is the mother of 6 sons all in HM. Forces (including the youngest - the prisoner - who has already served in 'your Majesty's Fleet'), the prisoner committed the crime when drunk. Initial sentence: death, respited for 7 days. Recommendation: no mercy. Folios 171-175.
