Report of John William Rose, Recorder of London, on John Smith, convicted at the 'last' sessions of the Old Bailey, for stealing a cloth cloak, value 5/-, property of James Callighan. Grounds for clemency: when the prisoner was taken to the bar for sentencing he was mistaken for another prisoner. Initial sentence: 7 years transportation (the other's prisoner's intended sentence). Recommendation: to enlist in HM. Navy or 12 months in the house of correction and to be fined 1/-, this was his intended (initial) sentence and it is to stand. Folios 72-73.
