The petitioner seeks an order from chancery for a commission to enquire into the right and title to the manor of Capel-le-Ferne, with appurtenances, and thus make right to the petitioner. He states that Cornwall was seised of the manor when Henry IV was king, and took all issues from the manor as of his fee. He enfeoffed the petitioner, Lobeney and Tredek, to hold to themselves and their heirs etc. They continued in possession until an enquiry held at Eltham, Wednesday 7 November 1414, before Lygon and Lee, the commissioners assigned to enquire into which lands, rents and tenements etc. belonged to Shelly proved that on the day of his forfeiture (Wednesday 4 February 1400), Shelly was seised in his demesne as of his fee of the manor of Capel etc., and upon this others entered by colour of letters patent from the king's father, dated at Westminster, 14 November 1414, which granted to the [then] king's good friend William Kerby the manor to hold for his lifetime, thus ousting the petitioner, Lobeney and Tredek. Then Lobeney and Tredek died and so the fee passed to the petitioner. Then Kerby died and Capell was taken into the king's hands, and there remains to the great prejudice of the petitioner.
