Nature of request
The petitioners ask that certain debts owed by the Flemings should be seized into the hands of Cook, Simon and Swanland in part satisfaction of their damages according to a similar case that appears on the rolls contained in the tower of London, and that debts were seized in the time of the king's father in 1304-5, and ordered by writ to be delivered to the litigants. They show that they have sued for a long time by due process against the count of Flanders by writ of arrest for recovery of goods and merchandise of which they were robbed by the power and lordship of the count and all the commonality of Flanders. By an award in the king's court in chancery seizure was ordered for the petitioners, who bought a writ from Constantine and Hackney to place into the hands of Cook, Simon and Swanland certain debts of Flemings as chattels, as stated in the answer made to the former sheriffs in chancery. The chancery would not order execution of this command because the said answer mentioned only debts and not goods or chattels, for which a day was granted by passage of time up to the last parliament held at York, for the third week of Easter 1322, and then Norwich, Beresford and Stonor were appointed justices by the king's commission to determine the matter at a day in the quindene of St John the Baptist following, and due warning was made. Stonor was unable to attend on the day and the other justices would not make an award in his absence, and so a day for their suit has still to be assigned.
