Description
Petitioners
Elizabeth du Castell (Castle), daughter of Sarah wife of Walter du Castell.
Name(s)
Castell (Castle), Elizabeth
Addressees
King and Council.
Nature of request
The petitioner seeks recovery of certain lands and tenements that she has been unable to recover by the common law. She shows that with Walter and Sarah they jointly purchased from the heirs of John Thaney, one messuage, sixty acres of land, ten acres of woodland, two acres of meadow and 7s rent with appurtenances, to them and the heirs of Walter, in Lewisham. After Walter's death Sarah (without the agreement of the petitioner who was a minor), sold the said lands and tenements to the bishop, to the impoverishment of the petitioner. The bishop then granted the same to the king, together with the lease of lands in Eltham, and then granted by the king to the queen with the manor of Eltham. The appurtenances in the said lands the queen granted to Deuery, his wife and their heirs without giving the petitioner any reasonable notice to answer. The petitioner showed her evidences to the queen and her council, who answered that right in the matter lay with the king.1)
Nature of endorsement
She is to come into chancery and show her charters and ... the same ... of ... and by chancery certified in respect thereof to the king.2) Coram Rege.

Note
The dating of the petition is uncertain; it dates some time during Anthony Bek's office as bishop of Durham (1283-1311), but the reference to the queen means that it must be before 1290 or after 1299: it is assumed, on the basis of the hand, that it is more likely to date within the later period, and that the queen in question is Margaret of France, which also means that the terminus ad quem is established at the point where Edward II married Isabella of France in 1308. This dating remains tentative.
