- The petitioners ask that capias and exigend be awarded in certain cases as in replevin, for the taking of property as ordered heretofore by statute, considering the greater harm of taking bodies as gaol delivery cannot be made from franchises according to the law of the land, and that this statute should be extended to process made as well in times past as in times to come. They show that a frequent complaint by the commons of the realm heretofore is that they are unable to secure capias or exigence of tenants out of their counties by the sheriffs, nor have delivery of lands, rents, goods, etc.
