Nature of request
The petitioner seeks recovery of lands in Devon and an opportunity to answer a scire facias sued toward him for the king, now at the quindene of St John, because he has not the power to stay in town very long. He shows that Horton by charter recently granted all his property to himself and Stephenson, to hold to them and their heirs forever, and afterwards they released by writing all their rights therein. Then it was established by an inquest held by Fitz Warin the escheator that the properties were held in chief of the king, and alienated and released without licence. For this the escheator took the properties and the inquest was returned into chancery, such that the petitioner (by fine in chancery) had a deed of pardon for the said purchase and release, and to recover by award, with a record of the same in chancery. Now he is ousted by inquest without answer, upon which he took a mandamus to the escheator of Devon to enquire whether or not Horton died seised of the aforesaid property. The petitioner is ready to prove by good indentures that the properties are not held of the king.
