Robert de Tyllol states that Joan, widow of Richard de Crossebi, is claiming her dower against him in the liberty of the bishopric of Durham, from lands with which her husband enfeoffed him in the same liberty, and he vouched to warranty Richard's heirs, who have lands in Cumberland but not in the liberty of Durham. Because the Bishop cannot distrain them to come to his court, he asked the King and council in the last parliament for help, and the King gave him his letter to the Sheriff of Cumberland to summon the heirs. Robert asks that the Sheriff might be ordered to obey the Bishop's commands in this plea until the judgment on the warranty is put into effect, or that the King, through his council, might provide some other means through which he might have justice.
Nature of endorsement
The justices are to inform the King.It is agreed by the justices that he is to take action by a writ of warranty of charter in the county of Cumberland, because it would be to the King's prejudice if the King granted to the Bishop that foreigners vouched to warranty could come within the liberty of Durham: for the Bishop would attract to himself and his liberty such foreigners throughout England, in such a way that it would result in manifest prejudice to the King.
