[This petition is damaged, and this summary may be incomplete.]Henry Bataill states that in the time of King Alexander, his ancestor, Simon Mansel, was seised of a site on which the Berefrait was built, and that he leased it to the community of the town of Berwick. And Henry and his ancestors were always seised of this rent until it was seized into the King's hand when Berwick surrendered. He requests a remedy and restitution of the rent.
Nature of endorsement
They say that Simon Mansel and the other ancestors of the said Henry were seised of the aforesaid site before the time of King Alexander etc., and gave it to the community of the aforesaid town, paying him and his heirs 20s per annum, and that the said community built the said Berefrait, and that the ancestors of the said Henry were seised of the aforesaid 20s until the town was captured by the King's grandfather, and that in the time of the King's grandfather and of his father they were not seised of it, and that after Robert de Bruys captured the town, Henry was seised of it, until Berwick came into the King's hand, and that it was in the town and he did not remise it.He is to have a writ to the Sheriff of Berwick to pay him the aforesaid rent if it is in the King's hand for the aforesaid reason and for no other, saving the right of the King and of anyone else.
