Reference
SC 8/93/4618
Date
[1375-c. 1380]
Description
Petitioners
John de Brent son of Thomas de Brent (John Fitz Thomas de Brent).
Name(s)
de Brent ; Fitz Thomas, John; John
Addressees
King and his council in this present parliament.
Nature of request
Fitz Thomas requests that the charter of the abbot of Glastonbury be brought before them and the justices so that according to a good declaration of the charter right and justice is able to be done to rich and poor alike. Fitz Thomas has brought an assize against the abbot, but the abbot has claimed cognizance of the assize by virtue of a charter granted to him by the king's predecessors that Fitz Thomas states to be insufferable and not maintainable by the law that a party can have cognizance of an assize, and it would leave him without a suit.
Nature of endorsement
[None]
Places mentioned
Brent, [Somerset].
People mentioned
Henry Percehay (Percy), justice of assize in Somerset
Walter Clopton, justice of assize in Somerset
John [Chynnok (Wynchestre)], Abbot of Glastonbury
John de Breynton, Abbot of Westminster
Thomas, father of the petitioner.
Note
The petition is during the period that John Chynnok was abbot of Glastonbury between 1375 and 1420. However the petition is unlike to be any later than 1388, as Walter Clopton became chief Justice of King's Bench in 1388 until his death in 1400 (Sainty, The Judges of England, pp.6 & 66).
