Reference
SC 8/92/4565
Date
[1318]
Description
Petitioners
Dean and canons of the church of St Buryan, Cornwall.
Addressees
King and council.
Nature of request
The dean and canons request that the justices in a case that they have pending before them in the Bench against the bishop of Exeter, be ordered to proceed to judgement as the case has been pending for five years or more, and in the meantime the bishop has been exercising all manner of jurisdiction of ordinary in the chapel against their liberty to their ruin.
Nature of endorsement
It is ordered to Scrope and his associates by writ that they should proceed without delay to render judgment, and if there should be difficulties so that they are unable to proceed, then the record is to be sent into parliament according to the form of the ordinance this Monday next after the feast of St Dunstan and the king and his council will consider what is to be done.
Places mentioned
St Buryan, Cornwall
Exeter diocese.
People mentioned
Walter [Stapledon], Bishop of Exeter
Richard Beaupree, the king's commissioner
Henry le Scrop (Scrope), justice.
Note
The petition can be dated to 1318, as the plea seems to have been initiated in c. 1314 (CCW 1244-1326, pp.402-3), and this was five years into the plea. In addition a later endorsement, which appears to have been put on this petition when it was part of a larger bundle, states that these are petitions of 11 and 12 Edw. II (1317-18). A later petition by the same petitioners on the same matter dates to 1322 and considered it to be eight years into the plea (SC 8/91/4528).
