Nature of request
Braylvef requests that the justices be ordered to proceed to take his assize notwithstanding the charter that Bynteworth and Ewer have presented to delay it. Braylvef has the mill at Eastrop, and Bynteworth coveting his tolls has diverted the watercourse then granting his land with a mill on it to the king and receiving it back, though no mill stood on it, and then building a mill. Braylvef's mill cannot mill except with Bynteworth's permission, and his plea is delayed by the royal charter.1)
Nature of endorsement
It is ordered to the justices that notwithstanding the charter they should take the assize and by the assize they should make enquiry of the truth, but they are not to proceed to judgment without consulting the king.2) Coram rege.
