SC 8/92/4555
Date
[c. 1346]
Description
Petitioners
Thomas le Brewere (Brewer) of London.
Name(s)
Brewere (Brewer), Thomas
Addressees
Council.
Nature of request
Brewere requests that the chancellor be ordered to make a writ to the mayor and sheriffs to proceed to do justice to the parties notwithstanding a writ of supersedeas which was against the law. It had been ordained that a levy was to be made on every sack of wool towards providing armed protection on all boats leaving English ports to go to Flanders. Wesenham had taken it from Brewere but did not wish to give safe-conduct and they were robbed, and following a plea to parliament he sued against Wesenham and others but judgment was delayed by a supersedeas against the statute.
Nature of endorsement
Because the king had charged his justices and other ministers to do justice to all, it is assented that the petitioner have a writ of Chancery to the mayor and sheriffs to proceed to final discussion in the plea before them not withstanding the writ of supersedeas.
Places mentioned
London
Flanders
Sluis, [Netherlands].
People mentioned
John de Wesenham, collector of money
Mayor and sheriffs of London.
Note
The petition dates to c. 1346 as the supersedeas to which this petition refers was issued on 20 November 1346 (CCR 1346-9, p.173). That this was a wider and continuing problem is revealed by the common petition complaining of the losses suffered by merchants despite the provision of protection for merchants going over seas at a rate of 12d. a sack of wool in the parliament of Hillary 1348 (Rot. Parl., vol. II::pp.171b-172a).
