Nature of request
John son of John de Assheton makes two requests concerning delays to pleas of account for the issues of lands and tenements in Ashton under Lyne:1) He states that one plea against William son of William de Radclife (or William Fitz William of Radcliffe) who had the wardship of certain lands and tenements while John was under age, has been delayed by the claim that William was in the King's service in Berwick upon Tweed - although he is over sixty and is not in Berwick. He asks that no protection should be granted to William, to delay his suit.2) Similarly, a plea concerning lands held in socage against John de Kyrkebi has been delayed by the claim that John was in Berwick in the King's service, although John too is over sixty, in poor health, and no longer in Berwick. Again, John asks that no protection be granted.

Note
Dated on the guard to c. 1375-1377 with reference to VCH Lancashire IV, 341, and Bain nos.208 & 252. No. 208 in Bain consists of three indentures whereby Thomas de Musegrave undertakes the keeping of Berwick upon Tweed: from Martinmas 1373 for a year, from Martinmas 1374 for a year, and from Martinmas 1376 (or possibly retroactively, from Martinmas 1375) for three years. No.252 is the account of Henry Percy, Earl of Northumberland, warden of the castle of Berwick upon Tweed, relevant because it mentions the capture of Thomas de Musegrave by the Scots on 27 August 1377. If the two men mentioned in the petition were supposed to be in Berwick with Musegrave, then this would seem to date the petition to c. 1373-c. 1377.
